1. Introduction

This website is owned and operated by Bonzoo Pty Ltd (ABN 67 526 958 230) of 33 Redland Drive, Mitcham, Victoria 3132 ("Bonzoo","us"," we")

These terms and conditions apply to any purchases made via this website, as well as general use and access to the website. You may only use or access this website, or purchase products via it, in accordance with and subject to these terms and conditions.

You should read these terms and conditions in conjunction with our Privacy Statement and any other notices and disclaimers which appear in this website (but only to the extent such notices and disclaimers are not inconsistent with these terms and conditions).These terms and conditions are subject to variation without notice and will apply as varied from time to time to all subsequent use and purchases by you.

2. Accounts

You must have an open account to purchase products via this website.

You may apply to open a new account by providing us with all information which we may reasonably require. If we accept your application, we will provide you with login details for accessing your account.

You are solely responsible for any activity that occurs on your account and you must keep your account login details secure. You must notify us immediately of any breach of security or unauthorized use of your account. Although we will not be liable for any loss to you caused by unauthorized use of your account, you may be liable for loss to us or others caused by such unauthorized use.

We may close your account if you are, or are reasonably likely to be, in breach of these terms and conditions or your account remains inactive for a continuous period of 12 months. Closure of your account does not in any way affect your obligation to pay any amounts owing to us for product purchases prior to the date of such closure.

3. Purchasing products

As an individual intending to acquire products for personal, domestic or household use, you may use the features and functionality on this website to purchase products offered from time to time on this website.

4. Product descriptions

The actual colours of products may vary slightly from those depicted on this website. We supply products on the basis that they will be used only for the specific purposes described on this website (if any). The selection of suitability of products to be used by children remains at the discretion of the purchaser. Our products should only be used by children under proper adult supervision. We may change the products offered on this website from time to time without notice.

5. Prices and delivery charges

All prices shown on this website are in Australian dollars, include GST and are subject to change without notice. Prices are displayed exclusive of delivery charges.

A standard delivery charge of $7.95 (including GST) will apply for each separate order you place through this website, irrespective of the number of items included in your order (up to a maximum of 20 items per order).

6. Payment and security

We only accept payments by major credit cards (including Visa, MasterCard and Diners Club) and payment by PayPal. We reserve the right to request additional evidence for proof of billing information prior to dispatching product orders.

All credit card payments will be transmitted through the eWAY gateway system. For your protection, your credit card order may be delayed to allow us to confirm your billing information with your financial institution. Your credit card statement will be marked "Bonzoo Pty Ltd" for purchases via this website. This website uses Secure Sockets Layer (SSL) technology software for information transmission. Information submitted through this website (including your credit card details) is encrypted using the same 128-bit security commonly used by banks. Despite these security measures, we will not be responsible for any damages, consequential losses (whether direct or indirect) suffered by you as a result of any fraudulent or unauthorised use of your payment method details (including your card details) by a third party.

7. Processing times

Our normal processing time for in-stock orders is 48 hours (excluding weekends and public holidays). You should typically expect to receive products within 7 days from the date of your order, however actual delivery times may vary depending on product availability and delivery address. We will contact you if we expect any substantial delay in processing your order or if a product you ordered is unavailable.

8. Delivery

We deliver to addresses in Australia by our nominated carrier, currently Australia Post eParcel. We may change our nominated carrier from time to time without notice. Depending on the carrier applicable to your circumstances, tracking details may be available once your order has been dispatched.

Your order will be delivered Monday to Friday between 8am and 6pm (excluding public holidays). To help ensure safe and prompt delivery, you may choose to nominate your work address as your delivery address (if you are not going to be home during normal working hours), however please check with your employer before doing so. If no one is present when delivery is attempted, your order will be made available for collection from a nearby Australia Post retail outlet, as indicated on the calling card provided. A signature will be required upon delivery. If there are any issues regarding delivery of your order we may contact you using the daytime phone number you have previously provided us.

Please note that while we take all reasonable steps to ensure your product is delivered in a timely manner, delays may occasionally occur as a result of our carrier which we have no control over. If any delay is caused by an event out of our reasonable control or foresight (including delay caused by us receiving an incorrect delivery address), we will not be liable for any loss or damage incurred by any person as a result of such delay.

9. Order cancellation

Although it is rare that it would be necessary for us to cancel an order, we reserve the right to do so (in addition to the right to not accept any subsequent orders from you) if you:

• provide erroneous or insufficient information in relation to your credit card number, expiration date or card security value, billing information (including where the billing information you provide is different from information your financial institution has on record) or delivery address.
• are, or are reasonably likely to be, in breach of any of these terms and conditions,
  in which case we will not be liable for any loss, cost or damage to any person (including customers) in respect of such cancelled order.

(c) Liability and indemnity
You acknowledge that you enter and use this website at entirely your own risk. Except as provided in these terms and conditions and to the extent permitted by law, we are not responsible for any direct, special, incidental or consequential loss, damage, claim or other liability howsoever arising including whether from:

• breach of any warranty or other provision of these terms and conditions (except in relation to death or personal injury claims, or any statutory liability for intentional and gross negligent acts and/or omissions); or
• any failure or technical issues that limits or prohibits access to or use of this website.

These terms and conditions are governed by the laws in force in the State of Victoria and you must submit to the non-exclusive jurisdiction of the courts of the State of Victoria (including the Federal Court of Australia).

(f) Inability to carry out obligations
If we are unable to perform any or all of our obligations under these terms and conditions by reason of an event which is not reasonably within our control including omissions or impositions by federal or national government authorities, fire, flood, earthquake and other natural disasters, acts of god, war, revolution, strike, fuel shortages and shortage of raw materials, we are relieved of those obligations to the extent and for the period that they are unable to be performed.

(g) Our employees and agents
None of our employees or agents have the authority to vary these terms and conditions in individual cases.

(h) Severability
The provisions of these terms and conditions will be deemed to be severable and any invalidity of any provision of these terms and conditions will not affect the validity of the remaining provisions of these terms and conditions.

(i) Transaction by minors
If we suffer any damage or loss as a result of a person who is under 18 years old entering into (or purporting to enter into a transaction via this website), we reserve the right to seek compensation from any parent or guardian of that person.

(j) Waiver
Any delay or failure by us to enforce any rights under these terms and conditions does not constitute waiver.

16. Discount vouchers

(a) 'Voucher' refers to any discount voucher, coupon, code or other such item that is issued by us for the purpose of granting discounted and/or free goods and/or services.

(b) Vouchers are only valid for purchases made via www.bonzoo.com.au and are subject to the normal Terms and Conditions of use of the website.

(c) Vouchers can only be redeemed during the online checkout process. Vouchers cannot be redeemed after the checkout process is completed nor can a refund or free or discounted good or service be issued in respect of a voucher after the checkout process has been completed.

(d) Any non-redeemed value of a voucher is forfeited if the redeemed value is less than the total value offered by the voucher.

(e) We reserve the right to cancel any voucher at any time.

(f) Vouchers are not transferable or redeemable for cash or other payment.

(g) Only one voucher can be applied to an order and vouchers cannot be used in conjunction with any other offer.

(h) Vouchers may have one or more eligibility criteria such as minimum quantity and/or value, and/or may only apply to certain products and/or at certain times. Refer to the specific criteria distributed with the voucher for details.

(i) Vouchers may have a limited number of redemptions including single-use vouchers. A voucher that has already been redeemed the maximum allowed number of times becomes invalid.

(j) Voucher discounts only apply to the product price, not to postage/handling or other applicable charges unless otherwise stated.

(k) If a voucher has a minimum purchase amount requirement, postage/handling or other applicable charges do not count towards the minimum purchase amount.

(l) Any 'Gift with purchase' promotions are only valid while stocks of the gift(s) last.

(m) Vouchers cannot be replaced if lost, stolen or deleted.
